Any order under product appearing in the online store site http://www.nippon-yasan.com (hereinafter "the Seller") requires consultation and prior acceptance of the present Terms of Sales. The validation click of the order implies full acceptance of the present. This click with value of "digital signature".


Object

These terms and conditions are intended to define the rights and obligations of the parties in connection with the online sale of goods offered by the Seller to the Buyer.


Product Information

All products on the site are 100% authentic. Note that Japanese products are destined for the Japanese market, and there may be products like video games, DVDs, consoles that can not work in other countries. Every effort has been made to ensure the accuracy of the information presented on the site. The photographs are as faithful as possible but can not ensure a perfect similarity with the product offered. They are therefore not contractual.


Price

The prices displayed on the site are indicated excluding shipping costs. Only the price indicated in the e-mail of confirmation of acceptance of the order of the Buyer is the final price. This price includes the price of the product or products, as well as transportation costs.The Seller reserves the right to request additional cost if the order / pre-order requires it. The Seller will inform the Buyer and give him the reasons for this additional cost.


Proof of the transaction

The computerized records stored in Seller's computer systems are considered as proof of communications, orders and payments between the parties.
The filing of purchase orders and invoices is done on a reliable and durable support that can be produced as evidence.
The Seller reserves the right to ask the Buyer for additional information in order to check the correspondence between the credit card used and the identity of the Buyer.
The information that will be transmitted by the Buyer will remain confidential and secure.
In case of refusal of the Buyer, the Seller will cancel the transaction and the pre-order / order legitimately.


Preorder

For pre-order products, two payment solutions are possible:

  •  If you wish to pay the full amount at the time of the order choose your method of payment. The shipment will be made automatically upon the official release of the product.
  •  If you wish to pay later, choose PAY LATER payment method. You can then pay for your order at any time by going into the history of your orders and clicking on "Pay my order"

 

You will have about 15 days from the day of receipt of this email to pay your order before cancellation.

Pre-orders are sent from the day of the official release in Japan. (Provided you have received all the stocks and placed your order early enough)

 WARNING:
All orders for in-stock items ordered at the same time as an item for pre-order will be sent at the same time as the pre-order. (The shipment will be in the same package as the pre-order.)
In this case, payment is mandatory when ordering. If you want a shipment of a product in stock without delay, we invite you to make a separate order.

In the case of an order, composed of several pre-order items WITH A DIFFERENT DATE OUTPUT, the package will be sent once the last of the pre-orders exits. (Payment must be made in full at the time of the first article.)

Concerning the price change of a pre-order product:

If the price in Yen of a pre-order product is seen to fall, you can ask us to update the price of your order with this new price.
This is valid only before the official release of the product.

If you want to benefit from the Yen, we advise you to place your order directly in Yen.
If your order is still not paid approximately 15 days before the official release, you will receive a payment notification.


Payment method

Payment must be made when ordering by the Buyer. At no time can the amounts paid be considered as a deposit or down payment.

The receipt of the total amount of the order will be made

 

Cancellation

Any order is final. The Seller does not accept any cancellation on orders or pre-orders already paid. The Buyer makes an order only if he is sure of his purchase.
 
Delivery method

The products are delivered to the address indicated by the Buyer on the order form.

We deliver to the world.

The related shipping costs are calculated automatically when placing the order.
The average delivery times of these methods from the Seller's deposit are as follows:

UPS Express Saver: 1-2 days (varies by country)
UPS Expedited: 3-4 days (Varies depending on the country)
EMS Express (Chronopost): 3-4 days
Trans-logistics: 8-10 days (*)
By Plane (Air Mail) (Recommended or not): 8-10 days
Economic (SAL) (Recommended or not): 2-3 weeks

The Buyer will be kept informed at each stage of his order until the shipment of his products by e-mail.

We will make bulk shipments by cargo plane orders from our customers who chose this method (at least one shipment per week), once in Europe our logistics partner will be responsible for redistribution on Europe (Schengen area only excluding DOM-TOM and Switzerland).
Depending on the delivery method chosen once in Europe it will be under 24H Express and under 48-72H Standard

Additional information on sending:
- Every Thursday the Transit-Logistique shipment will be made.
- Orders placed on Monday before 9am (Japanese time) will be sent on Thursday of the same week
- Orders placed on Monday after 9am (Japanese time) will be sent on the Thursday of the following week.
In order to comply with European regulations, VAT will be included in the order.
Standard deliveries will be made with Colissimo Expert for France, GLS for Europe except for the following countries: Greece, Iceland, Malta, Norway which will be carried out by Colissimo Expert International
Nippon-yasan.com reserves the right to delay or advance the sending of the transit-logistic group.


Delivery problem due to the transport

All products leaving our premises are in perfect condition. The Seller is in no way responsible for damage due to transport. The Buyer must notify the carrier of any anomaly on the package, and if necessary refuse the package. He will write in the presence of the carrier if possible a claim and send it to us within 3 days from receipt.
After this period, the request of the Buyer will be automatically rejected.
As in any shipment, it is possible to be late or the product goes astray. In such a case, we contact the carrier to start an investigation. All efforts are made to find the package. In this case, the Buyer will be reimbursed by the carrier for the value originally declared as well as part of the associated shipping costs.
The Seller is not responsible for the lengthening of delivery times due to the carrier.

In case of return of the parcel, whatever the reason (absence, unclaimed, incomplete address ...) the expenses of return will be charged to the customer.




Parcel insurance

Depending on the shipping method chosen a parcel is insured up to a certain amount:
UPS: Depends on the declared value on the parcel
EMS: Up to 20000 Yen
Trans-logistics: Depends on the value declared on the parcel
Airmail Registered: from 0.1kg to 2kg 6000 Yen, over 2kg 20000 Yen
Eco Sal Registered: from 0.1kg to 2kg 6000 Yen, over 2kg 20000 Yen
Ferry: from 0.1kg to 2kg 6000 Yen, over 2kg 20000 Yen
These amounts are the maximum amount that can be reimbursed by the postal service.
However, if a lower amount is indicated, the amount taken into account for a refund request is that indicated on the package.


Customs Fees

Any order placed on the Site may be subject to taxes and customs duties that are imposed when the package reaches its destination. These customs duties and any taxes related to the delivery of an item are the responsibility of the Buyer and are the responsibility of the Buyer.

Product warranty

The Seller is not the manufacturer of the products presented and disclaims any liability for defective products.
Accordingly, in the event of damage to a person or a product by default of the product, only the responsibility of the manufacturer may be sought by the Buyer on the basis of the information on the packaging of the said product.
The warranty period is covered by a manufacturer's warranty. If the Buyer encounters a problem with a product purchased on the Site during the year following its purchase, he may contact the Customer Service of the Seller, and return at his own expense the article concerned (Recommended only to the Seller, to the address indicated in these Terms and Conditions of Sale.). The Seller will then follow the article to the Japanese service of the manufacturer concerned. The Buyer shall pay the return postage.
Any return of the product under the aforementioned warranty must be subject to prior approval of the Seller. No returns will be accepted without prior authorization of the Seller. This warranty excludes all products that have been modified or repaired by the Buyer or any other entity.

Applicable law


These terms and conditions are subject to Japanese law, and therefore to a Japanese court. This is so for the substantive rules as for the rules of form.
In case of dispute or claim, the Buyer will first contact the Seller to obtain an amicable solution.
In case of sale to a legal person, any dispute relating to the sale (price, GTC, products ...) is the Japanese law.

 

Financial dispute, Termination of Service and Account Closure

The Buyer that has decide to engage in a financial dispute, being this by Paypal dispute or Chargeback, will immediatly have the account closed and termination of all service provided related to the Buyer, The Seller will provide all the support necessary to solve any issue has affected the Buyer to the extent that is possible for The Seller, it is recommended to resolve the issue directly with The Seller than to engage in financial dispute.


Protection of personal data

All Buyer data is personal and secure in order to process orders, payment data is provided directly to the payment processing companies, Nippon-Yasan.Com does not store financial data of the customer, only the necessary personal data to deliver the orders.

 

SHOPPER-FACING TERMS

(a)  Payment Processing: Nippon-Yasan.Com ("Supplier") provides international payment processing and order fulfillment through its designated service provider, Calgary Foreign Exchange Ltd. (doing business as GoInterpay) ("GoInterpay") as the Merchant-of-Record. When placing an order through Supplier, your order will be processed using GoInterpay checkout and payment processing services, and you acknowledge and agree that: (a) your payment transaction will be processed via GoInterpay, not Supplier, and (b) upon successful verification and authentication by GoInterpay of payment information provided by you, GoInterpay will accept the transaction, and purchase the products from Supplier for the sole purpose of reselling such products to you at a price equal to the amounts presented to and agreed-upon by you. GoInterpay will provide the merchant or Supplier with its own payment information to purchase the products you have ordered, and GoInterpay will resell such products to you and bill the payment information you have provided. GoInterpay acquires flash title to the products when the products exit the jurisdiction of Supplier. After GoInterpay purchases and takes title to products from the the Supplier to fulfill an order you have placed, you take title from GoInterpay before the products enter the jurisdiction that you have designated as your address for delivery. All items purchased from GoInterpay are made pursuant to a shipment contract. In the event of any disparity or inconsistency between the terms of any shipment contract or order fulfilment terms, the terms of this agreement shall prevail to the extent required to resolve the disparity or inconsistency.

(b)  Billing. If you provide a credit card as your tender type, your credit card will be billed by GoInterpay, and charges to your account will be accompanied by the descriptor “GoInterpay” (or such other descriptor as GoInterpay may deploy), which denotes the GoInterpay system, and that GoInterpay is the supplier whose products you have purchased through GoInterpay. If you paid using your PayPal account, charges to your account will be accompanied by the descriptor “MERCHANT VIA GOINTERPAY” (or such other descriptor as GoInterpay may deploy). In either case, you will only be billed after your products have been received, processed and dispatched for delivery by GoInterpay. In the event of the receipt of any parcel from Supplier containing only part of an order, GoInterpay will process the products received, and will only bill for an amount commensurate with the price of the products therein, pro-rated amounts for shipping and/or handling, plus any duty, taxes, VAT (unless GoInterpay and Supplier offered, and you accepted, the option of having your order shipped DAP (‘delivered at place’)). Notwithstanding the foregoing, in the event of an order being fulfilled by Supplier in multiple parcels, unless expressly consented to by you, in no instance will the aggregate amount billed to you by GoInterpay exceed the total amount presented at the time of order placement by you. If there is a technical error in the GoInterpay system which processes or accepts a transaction at an exchange rate which is manifestly off-market, that transaction shall be void.
